Short notice and information on Social Security Agreement between India and Belgium
ON BASIS OF THE PRESENT NOTE, THE CONSULATE GENERAL OF THE REPUBLIC OF INDIA IN ANTWERP RELEASES THE FOLLOWING INFORMATION ABOUT THE RECENT SOCIAL SECURITY AGREEMENT BETWEEN INDIA AND BELGIUM
The Kingdom of Belgium and the Republic of India concluded an Agreement to arrange the mutual relations between the two countries in the field of social security.
The objective of the Agreement is that the persons, who ordinarily reside in the territory of A Contracting State, shall receive equal and the same treatment of nationals of that Contracting State in the application of the social legislation of that Contracting State.
The most important requirements (unless otherwise provided) for Indian Nationals are the following:
- Indian Nationals, who work as an employee in the territory of Belgium, are only subject to the legislation Belgium, with respect to that employment.
When an Indian employer sends an employee to work in Belgium on a temporary basis (duration of his work does not exceed 60 moths), the employee shall remain subject to the legislation of India and continues to pay contributions under the legislation of India.
- Indian Nationals, who have paid or will be paying Belgian social security contributions, will be able to benefit from a Belgian pension upon their retirement in India.
This Agreement has been published in the Belgian Law Gazette the 21st of August 2009, and entered into force the 1st of September 2009. |
